Section 01 — Definitions
In these Terms, “MyWebsite” refers to the web development agency operating under MyInfluencers.org. “Client” means the individual or entity engaging MyWebsite. “Services” include all website design, development, SEO, hosting, and related digital services.
Section 02 — Service Agreement
By engaging MyWebsite, the Client agrees to these terms. The scope of each project shall be defined in a written proposal. Work outside the agreed scope constitutes a change order and may incur additional fees.
Section 03 — Intellectual Property
⚠ All code, designs, graphics, and website files developed by MyWebsite remain the exclusive intellectual property of MyWebsite. Clients receive a non-exclusive license to use the live website as a service during their active subscription.
Section 04 — Pricing & Payment
Setup fees: Starter $149 · Growth $399 · Professional $799 · Enterprise from $1,499. Monthly retainer of $49/month for SEO, monitoring, and support. All fees non-refundable once work has commenced.
Section 05 — Domain Registration
MyWebsite registers domains priced at $19.99/year or less. Higher-cost domains must be covered by the Client. Renewal beyond the first year is the Client's responsibility.
Section 06 — Service Continuity
Active subscribers receive continued website access, SEO management, and support. Cancelled subscriptions may result in the website going offline within 30 days of final payment.
Section 07 — Client Responsibilities
Providing accurate information, reviewing designs within 5 business days, paying fees on time, and ensuring content does not infringe third-party rights.
Section 08 — Confidentiality & Data Protection
Both parties maintain confidentiality. Upon acceptance, we collect and securely store your name, email, and contact information for contract administration. You may request access, correction, or deletion of your data.
Section 09 — Warranties
Services performed with reasonable skill and care. No guarantee of specific SEO rankings or traffic. Websites provided “as is” after approval period.
Section 10 — Limitation of Liability
MyWebsite is not liable for indirect, incidental, or consequential damages. Total liability limited to fees paid in the three months preceding any claim.
Section 11 — Indemnification
The Client agrees to indemnify MyWebsite against claims arising from Client-provided content, breaches, or unlawful use.
Section 12 — Force Majeure
Neither party liable for delays due to circumstances beyond reasonable control including natural disasters, pandemics, cyber attacks, or infrastructure failures.
Section 13 — Governing Law
Disputes resolved through good-faith negotiation before formal arbitration. Each party bears its own costs unless ordered otherwise.
Section 14 — Amendments
MyWebsite may update these terms with 30 days' notice. Continued use constitutes acceptance. This Agreement constitutes the entire agreement between the parties.
