Service Agreement
By engaging MyWebsite for web development services, the client agrees to the terms outlined herein. These terms govern all website development, SEO, and ongoing maintenance services provided by MyWebsite. This agreement is effective upon the client's first payment or written confirmation of intent to proceed.
Intellectual Property & Asset Ownership
Important: All digital assets, code, designs, graphics, and website files developed by MyWebsite remain the exclusive intellectual property of MyWebsite. Clients receive a license to use the live website as a service, but do not own the underlying assets. This reflects the service-based nature of our offering.
This licensing model allows us to continuously improve, maintain, and support your website throughout the subscription period. Upon cancellation of the monthly retainer, access to the live website and its hosted assets will be discontinued in accordance with Section 5.
Pricing & Payment
- Setup fees vary by plan: Starter $149 · Growth $399 · Professional $799 · Enterprise from $1,499 — due before project commencement.
- A monthly retainer of $49/month applies to all plans for ongoing SEO, monitoring, and support.
- Failure to maintain the monthly subscription may result in service suspension.
- All fees are non-refundable once work has commenced.
- Invoices are issued digitally and are due within 5 business days of issuance.
Domain Registration
- MyWebsite will register a domain on behalf of the client for domains priced at $19.99/year or less.
- Domain registration fees above $19.99/year must be covered directly by the client.
- Renewal of domain registration beyond the first year is the client's responsibility unless otherwise agreed in writing.
- MyWebsite holds no ownership over registered domains — they remain the property of the client business.
Service Continuity
Active monthly subscribers receive continued access to their live website, SEO management, and support. If a subscription is cancelled, MyWebsite reserves the right to take the website offline within 30 days of the final payment. We recommend exporting any content you require prior to cancellation.
Client Responsibilities
- Providing accurate business information and content in a timely manner.
- Reviewing and approving designs within 5 business days of submission.
- Paying all fees on time as agreed.
- Covering domain costs exceeding the $19.99 threshold.
- Notifying MyWebsite of any changes to business information that may affect SEO or website content.
Limitation of Liability
MyWebsite is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Total liability is limited to fees paid in the three months preceding any claim. We do not guarantee specific search engine rankings or traffic outcomes, as these depend on factors beyond our control.
Governing Law
These terms are governed by applicable law. Any disputes arising from or related to these terms or our services shall be resolved through good-faith negotiation before formal legal remedies are pursued. MyWebsite reserves the right to seek injunctive relief where appropriate.
Amendments
MyWebsite reserves the right to update these Terms & Conditions with 30 days' written notice to active clients. Continued use of our services after the notice period constitutes acceptance of the revised terms. The most current version will always be available at mywebsite.myinfluencers.org/terms.
